Terms and Conditions

Acknowledgment of Program Plans

I, the undersigned, acknowledge that I have read and understood the program offering (“training”), including but not limited to the schedule, topics, activities, and general objectives. I am aware of the nature of the training and confirm my willingness to participate fully in accordance with the outlined plans.

Definitions and Scope

For the purpose of these Terms and Conditions, the following definitions apply:

Organizer

Refers to LinkConsult, GEMS Consulting and the ASEAN Total Rewards Institute, including their affiliates, representatives, trainers, and employees.

Participant

Refers to the individual registering for and attending the training program.

Program / Training

Refers to the specific course, workshop, or session conducted by the Organizer.

Fees

Refer to the total charges payable for participation in the Program.

Force Majeure Event

Refers to any event beyond the reasonable control of the Organizer that prevents or delays performance, including but not limited to natural disasters, acts of government, strikes, or public health emergencies.

Payment Terms

• All fees must be paid in full prior to the commencement of the Program unless otherwise agreed in writing by the Organizer.
• Payment may be made via the methods specified in the registration form or invoice.
• Failure to complete payment within the prescribed time may result in cancellation of the registration without refund or access to the Program.
• Fees are non-refundable, except in extenuating circumstances subject to the Organizer’s discretion.

Cancellation & Refund Policy

• The Organizer may cancel, postpone, or reschedule the Program due to unforeseen circumstances (e.g., insufficient enrollment, trainer unavailability, or Force Majeure Events).
• In such cases, participants will be offered either a transfer to another session or a full refund.
• Participant-initiated cancellations are non-refundable unless otherwise approved by the Organizer in writing under exceptional circumstances.

Force Majeure

Neither the Organizer nor the Participant shall be held liable for any failure or delay in performing their obligations under these Terms due to a Force Majeure Event. If such an event occurs, the affected party shall promptly notify the other party, and obligations will be suspended for the duration of the event.

Participant Conduct

Participants are expected to conduct themselves in a professional and respectful manner throughout the Program. The Organizer reserves the right to remove any participant who engages in inappropriate, disruptive, or unlawful behavior, without refund or compensation.

Intellectual Property

All training materials, documentation, presentations, and content provided during the Program remain the exclusive intellectual property of the Organizer or its licensors. Participants may use such materials solely for personal learning and may not reproduce, distribute, or use them for commercial purposes without prior written consent from the Organizer.

Confidentiality

Participants agree to maintain strict confidentiality over any proprietary, confidential, or sensitive information disclosed during the Program, whether relating to the Organizer, other participants, or third parties. This obligation shall survive the completion of the Program.

Personal Insurance & Liability

I understand and acknowledge that personal accident insurance or any other form of insurance coverage for participants attending the training shall be taken up by the participant individually. It is my sole responsibility to secure and maintain adequate personal insurance coverage (e.g., personal accident insurance, health insurance, travel insurance) to cover any potential risks, injuries, or unforeseen circumstances that may arise during my participation in the training, including travel to and from the venue and during all training activities.

I hereby agree to indemnify and hold harmless LinkConsult and the ASEAN Total Rewards Institute (the “Organizer” or the “Organizers”), its employees, agents, representatives, and trainers from and against any and all claims, demands, actions, liabilities, costs, and expenses (including legal fees) arising out of or in connection with any personal injury, illness, death, loss, or damage to property that I may suffer or incur during or as a result of my participation in the training, whether or not such injury, illness, death, loss, or damage is caused by the negligence of the Organizer or any other party. This indemnity extends to any claims brought by my heirs, executors, administrators, or assignees.

Personal Data Protection Act (PDPA) – Use of Image

I understand and acknowledge that photographs, video recordings, and/or audio recordings may be taken during the training for documentation, promotional, or archival purposes by the Organizer. By signing the registration form, I grant the Organizer and its authorized representatives permission to capture, use, reproduce, publish, and disseminate my image, likeness, voice, and/or statements in any media (including print, digital, social media, and websites) in connection with the promotion, reporting, or future marketing of the Organizer’s training programs and activities.

I understand that I will not receive any compensation for such use. I may withdraw this consent at any time by providing written notice to the Organizer; however, materials already produced or published prior to the withdrawal may continue to be used.

General Indemnity

I agree to indemnify and hold harmless the Organizer, its employees, agents, representatives, and trainers from and against any and all claims, demands, actions, liabilities, costs, and expenses (including legal fees) arising out of or in connection with any act or omission by me during my participation in the training, including but not limited to any damage to property or injury to other persons.

Limitation of Liability

To the maximum extent permitted by law, the Organizer’s total liability arising from or in connection with the Program, whether in contract, tort, or otherwise, shall not exceed the total fees paid by the Participant. The Organizer shall not be liable for any indirect, consequential, or incidental losses, including loss of profits or data.

Governing Law and Dispute Resolution

This Indemnity and Acknowledgement shall be governed by and construed in accordance with the laws of the UAE. Any dispute arising out of or relating to these Terms shall first be resolved amicably through good-faith negotiation between the parties. If unresolved within thirty (30) days, the dispute shall be submitted to mediation or arbitration in the United Arab Emirates under applicable UAE law. The decision of the appointed arbitrator shall be final and binding on both parties.

Acknowledgment and Signature

By signing or submitting the registration form, the Participant confirms that they have read, understood, and agreed to these Terms and Conditions, including all supplemental clauses above. I confirm that I am signing this form voluntarily and of my own free will.
